Regulation 2023/1772 amending Regulation 923/2012 as regards ATM and ANS systems
COMMISSION IMPLEMENTING REGULATION (EU) 2023/1772 of 12 September 2023 amending Implementing Regulation (EU) No 923/2012 as regards the operating rules related to the use of Air Traffic Management and Air Navigation Services systems and constituents in the Single European Sky airspace and repealing Regulation (EC) No 1033/2006 - text published in the Official Journal of the European Union
Objective
To amend Regulation 923/2012 as regards air traffic management and air navigation services systems and constituents.
Summary
The following list contains a brief description of the most notable changes to Regulation 923/2012:
- Expanded the scope of the Regulation to include the Network Manager (NM).
- Added seven new definitions.
- Updated the provisions for flight plan (FPL) submission:
- Added a requirement that a flight plan is to be submitted to the NM (directly or via an ATS reporting office) if the flight is to operate within SES airspace.
- Expanded the provisions regarding the FPL submission time frame. The FPL must be submitted:
- not more than 120 hours before the estimated off-block time;
- at least 3 hours before the EOBT for flights that may be subject to air traffic flow management measures and at least 60 minutes before departure for all other flights.
- at a time which ensures its receipt by the appropriate ATS unit, at least 10 minutes before entry (if submitted during flight).
- Added a provision for a situation where an FPL has not been received by the NM.
- Added a clarification that the provisions regarding FPL submission are not applicable outside the EUR region.
- Added explicit provision that submitted FPLs must comply with the instructions set out in Appendix 6 as well as any constraints in relevant AIPs.
- Added explicit provision that submitted FPLs must contain informaion about communication (including datalink) and transponder equipment as well as any exemptions.
- Added provisions for FPL acceptance and information exchange defining:
- the process of acceptance of the FPL (and relevant changes) by the NM.
- the dissemination of the FPL (and relevant changes).
- the flows of information between the NM, the ATC units, the FPL originator (and the pilot/operator if different from the originator).
- Updated the provisions regarding changes to an FPL (only applicable to flights within the EUR region):
- Changes to an FPL must be reported to the NM (for the pre-flight phase) or the relevant ATC unit (during the flight).
- Delays of more than 15 minutes for IFR flights must be communicated to the NM. Delays of 30 minutes or more for controlled flights (1 hour for uncontrolled flights) require FPL amendment or cancellation and resubmission.
- Changes to aircraft equipment must be communicated to the NM or the ATS reporting office.
- Added a section containing CPDLC procedures:
- Data link initiation and data link initiation failure
- Establishment of CPDLC
- Transfer of CPDLC
- Construction of CPDLC messages
- Responding to CPDLC messages
- Correction of CPDLC messages
- Controller data link communication procedures for emergencies, hazards, and CPDLC equipment failure
- Intentional shutdown of CPDLC system
- Discontinuation of the use of CPDLC requests
- Use of CPDLC in the event of air–ground voice communication failure
- Testing of CPDLC
- Added Appendix 6 COMPLETION OF A FLIGHT PLAN, containing an FPL form and instructions for completion. These are the same as the provisions set out in Appendix 2 of ICAO Doc 4444.
Entry into Force
This Regulation entered into force in October 2023.
This Regulation repeals Regulation 1033/2006.
