7.2.5 State approval of Article 10 SPR arrangements between MET service providers

FAB requirement (Mandatory)

N.B. In cases of ANS providers availing themselves of the services of other service providers (as per Article 10.1 SPR).

Article 10.3 SPR: In cases involving the provision of meteorological services, the approval of the Member States concerned shall be required if they have designated a provider on an exclusive basis in accordance with Article 9(1) SPR.

While Article 10.1 SPR sets an optional condition, Article 10.3 sets a mandatory requirement once two ANSPs have opted for entering into a voluntary arrangement in accordance with Article 10.1 SPR and involving the provision of meteorological services by a provider designated on an exclusive basis in accordance with Article 9(1) SPR.

This requirement should be considered closely in relation to the requirements and options dealt with in sections 7.2.2 (optional designation of a MET service provider) and 7.2.3 (Article 10 SSPR agreements/ arrangements among ANSPs). The explanatory material in section 7.2.4 also applies in this case, with the notable difference that the competent authority/ authorities in a FAB for granting approvals involving the provision of MET services may be different than the authority/ authorities with respect to ATS provision.

FAB Stakeholder(s) concerned

Depending on whether a MET service provider has been designated on an exclusive basis in accordance with Article 9(1) SPR, the Member State concerned should make appropriate legal provisions as regards which is the competent authority responsible for issuing the specific approvals required on behalf of that Member State in the frame of Article 10.3 SPR SPR and in case of MET service provision. In a FAB, Member States may agree on different arrangements in this respect from the previous arrangements at national level.
